License

This License Agreement (the "License") governs your use of any digital content, including but not limited to images, artwork, e-books, software, and other digital files (each, a "File") that you purchase, download, or otherwise obtain through Creeative Inc. ("Creeative", "we", "us", or "our") and the Creeative website at creeative.com (the "Site"), together with all related websites, software, mobile apps, and other services (together, the "Service").

By purchasing, downloading, or otherwise using any File made available through the Service, you agree to be bound by the terms of this License. If you do not agree to these terms, you may not download, use, or otherwise access any File.

1. Grant of License

Subject to your compliance with this License and Creeative's Terms of Service, Creeative grants you a limited, non-exclusive, non-transferable, non-sublicensable license to use each File you have lawfully purchased or obtained, solely as permitted under the license type applicable to that File (see Section 2).

2. License Types

Creeative may offer one or more of the following license types for a given File. The applicable license type will be indicated at the time of purchase.

A. Standard License – permits use of the File for personal or internal business purposes, including in digital and print projects, provided the File is not resold, redistributed, or sublicensed on a standalone basis.

B. Extended / Commercial License – permits broader commercial use of the File, such as incorporation into products for resale, merchandise, or large-scale distribution, as specifically described at the time of purchase.

Where no license type is specified, the Standard License shall apply.

3. Permitted Uses

Under a valid license, you may:

A. Use, reproduce, and modify the File for the purposes permitted under your license type;

B. Incorporate the File into your own creative, marketing, editorial, or commercial projects, subject to the restrictions in Section 4;

C. Make a reasonable number of copies of the File for backup or archival purposes.

4. Restrictions

Regardless of license type, you may not:

A. Resell, redistribute, sublicense, rent, lease, or share the original File, in whole or in part, on a standalone basis or as part of a competing digital asset service;

B. Claim exclusive ownership or copyright over any unmodified or minimally modified File;

C. Use the File in any manner that is unlawful, defamatory, obscene, or infringes the rights of any third party;

D. Use any trademarks, logos, or brand elements that appear within a File in a manner that suggests endorsement or affiliation with the trademark owner, unless separately authorized;

E. Use the recognizable likeness of any individual appearing in a File in a manner implying endorsement, or in connection with sensitive subject matter (e.g., pornographic, defamatory, or unlawful content), without obtaining the necessary rights or releases;

F. Use any underlying artwork, design, or work of authorship appearing within a File in a manner that infringes the rights of the original artist or author;

G. Remove, obscure, or alter any copyright notice, watermark, or attribution embedded in a File;

H. Copy the look and feel of the Site, or use any File to create, contribute to, or populate a similar or competing digital asset service;

I. Reverse engineer, decompile, or otherwise attempt to extract the source files, templates, or underlying components of any File or the Service beyond what is provided.

5. Ownership

All Files remain the intellectual property of Creeative or its third-party content suppliers and are protected under applicable copyright and intellectual property laws. This License grants you a right to use the File as described above; it does not transfer any ownership, copyright, or other intellectual property rights in the File to you.

6. Third-Party Elements

Some Files may contain elements owned by third parties, including trademarks, logos, brands, recognizable individuals, or third-party artwork. Your license to use a File does not extend to a separate right to use such third-party elements independently, and you are responsible for obtaining any additional permissions or clearances required for your intended use.

7. No Refunds

Licenses are granted upon purchase and, except as required by applicable law, are non-refundable once a File has been downloaded. Please review the license type and File description carefully, or contact us with any questions, before purchasing.

8. Termination

This License, and your right to use any File, will terminate automatically if you breach any term of this License or Creeative's Terms of Service. Upon termination, you must immediately cease all use of the applicable File(s) and destroy any copies in your possession.

9. Disclaimer and Limitation of Liability

Files are provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, Creeative shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of any File.

10. Changes to This License

We may update or modify this License at any time. Continued use of any File following such changes constitutes your acceptance of the updated License. Material changes will not affect the license rights already granted for Files purchased prior to the change.
